The Guernsey and jersey CD racket can only be a sham

The BBC reported an important development in the CD market yesterday. As they noted:

Online music store CD-Wow has been found in contempt of court for selling illegally imported cheap CDs in the UK.

The High Court in London ruled that the site's owners, Music Trading Online, were "in substantial breach" of a 2004 agreement to stop selling such albums.

The result is fairly straightforward. The only source for the CDs now shipped from the Channel Islands to the UK is now the EU, which in effect means the UK as English language products are sold, in the main. The pure tax sham that is taking place is now exposed as having no 'market' function or competitive effect. It's just a fiddle.

One hopes the Treasury agrees when it responds to the threat of a judicial review on the issue in April.
