More than a little off-topic for this particular post, but have you seen the Supreme Court’s decision on Tower MCashback yet? There’s some encouraging stuff in there, not least the result! See for example paragraph 80. The tax advisory industry constantly whinges about the need for “certainty”, but “any uncertainty that there may be will arise from the unremitting ingenuity of tax consultants and investment bankers determined to test the limits of the … legislation.”
