{"id":58984,"date":"2021-09-04T08:14:47","date_gmt":"2021-09-04T07:14:47","guid":{"rendered":"https:\/\/www.taxresearch.org.uk\/Blog\/?p=58984"},"modified":"2021-09-04T08:14:47","modified_gmt":"2021-09-04T07:14:47","slug":"what-can-be-done-about-tax-havens","status":"publish","type":"post","link":"https:\/\/www.taxresearch.org.uk\/Blog\/2021\/09\/04\/what-can-be-done-about-tax-havens\/","title":{"rendered":"What can be done about tax havens?"},"content":{"rendered":"<p class=\"s3\"><span class=\"s2\">In the <a href=\"https:\/\/www.taxresearch.org.uk\/Blog\/2021\/08\/31\/what-is-a-tax-haven-3\/\" target=\"_blank\" rel=\"noopener noreferrer\">first four videos in this series on tax havens<\/a> I have explored <a href=\"https:\/\/www.taxresearch.org.uk\/Blog\/2021\/09\/01\/what-are-tax-havens-used-for\/\" target=\"_blank\" rel=\"noopener noreferrer\">how they work<\/a>, what <a href=\"https:\/\/www.taxresearch.org.uk\/Blog\/2021\/09\/02\/how-do-tax-havens-work\/\" target=\"_blank\" rel=\"noopener noreferrer\">they abuse<\/a>, and why <a href=\"https:\/\/www.taxresearch.org.uk\/Blog\/2021\/09\/03\/why-are-tax-havens-harmful\/\" target=\"_blank\" rel=\"noopener noreferrer\">that abuse should worry anyone<\/a> who is concerned for fair markets, the rule of law and democracy, <\/span><span class=\"s2\">all of<\/span><span class=\"s2\"> which tax havens <\/span><span class=\"s2\">(<\/span><span class=\"s2\">or secrecy jurisdictions <\/span><span class=\"s2\">as I prefer to call them) <\/span><span class=\"s2\">actively seek to undermine. \u00a0<\/span><\/p>\n<p class=\"s3\"><span class=\"s2\">This then leads to the obvious question, which is what can be done to tackle the abuse that tax havens promote? I have spent years addressing this topic and in this <\/span><span class=\"s2\">video<\/span><span class=\"s2\"> I highlight four of the themes that I have worked on.<\/span><\/p>\n<p class=\"s3\"><span class=\"s2\">The first of these tackles the abuse of tax havens by multinational corporations. In 2003 I created the concept of country-by-country reporting, which requires that multinational companies report their trading activities, tax related cash flows and limited balance sheet data for each jurisdiction in which they have an operation. My <a href=\"http:\/\/visar.csustan.edu\/aaba\/ProposedAccstd.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">original 2003 proposal is here<\/a>.\u00a0 In 2015 the OECD adopted this idea as a key component of their Base Erosion and Profit Shifting programme that tackled tax haven abuse. The requirement to account in this way is now a legal requirement in more than 90 countries. <\/span><span class=\"s2\">However,<\/span><span class=\"s2\"> there is a major flaw still, and that is that all this accounting for transparency <\/span><span class=\"s2\">still <\/span><span class=\"s2\">takes place in secret. We need this data in the accounts of public companies as well.<\/span><span class=\"s2\"> Then we will all be able to see who is, and is not, abusing tax havens. <\/span><\/p>\n<p class=\"s3\"><span class=\"s2\">Second, there is automatic information exchange from tax havens<\/span><span class=\"s2\">. This involves the<\/span><span class=\"s2\"> supply of data from <\/span><span class=\"s2\">secrecy jurisdictions<\/span><span class=\"s2\"> to the <\/span><span class=\"s2\">tax authorities of the countries<\/span><span class=\"s2\"> where those who have accounts in th<\/span><span class=\"s2\">ose<\/span><span class=\"s2\"> places<\/span><span class=\"s2\"> really live<\/span><span class=\"s2\">. This has been a legal requirement <\/span><span class=\"s2\">for<\/span><span class=\"s2\"> several years now, but <\/span><span class=\"s2\">the question is, <\/span><span class=\"s2\">is it really working?<\/span><\/p>\n<p class=\"s3\"><span class=\"s2\">That brings me to my third theme<\/span><span class=\"s2\">, <\/span><span class=\"s2\">which <\/span><span class=\"s2\">is the need for properly functioning company registers, everywhere, and not just in tax havens. In my onion company registers should show that a company exists, what it does, who owns it, who manages it, who benefits from it <\/span><span class=\"s2\">i<\/span><span class=\"s2\">f not <\/span><span class=\"s2\">any <\/span><span class=\"s2\">those <\/span><span class=\"s2\">previously mentioned <\/span><span class=\"s2\">people<\/span><span class=\"s2\">,<\/span><span class=\"s2\"> and what it actually does <\/span><span class=\"s2\">i.e.<\/span><span class=\"s2\"> its accounts should be available, and in full. That is because companies enjoy the privilege of limited liability which comes at potential cost to the rest of society and transparency is a <\/span><span class=\"s2\">requirement<\/span> <span class=\"s2\">as a consequence of<\/span><span class=\"s2\"> that. Almost no tax haven provides this data <\/span><span class=\"s2\">as yet<\/span><span class=\"s2\">. It is hard enough to get in the rest of the world. And without <\/span><span class=\"s2\">it<\/span><span class=\"s2\"> automatic information exchange cannot really function, which is why this is key. <\/span><\/p>\n<p class=\"s3\"><span class=\"s2\">Fourth, extending this transparency requirement to trusts simply extends the reach of the measures I suggest for companies in a way that is necessary to break tax haven secrecy, where trusts are often used to add to the opacity of these places.<\/span><\/p>\n<p class=\"s3\"><span class=\"s2\">I explore all these issues in the video.
