{"id":29103,"date":"2015-05-21T07:24:11","date_gmt":"2015-05-21T06:24:11","guid":{"rendered":"http:\/\/www.taxresearch.org.uk\/Blog\/?p=29103"},"modified":"2015-05-21T07:24:11","modified_gmt":"2015-05-21T06:24:11","slug":"it-is-time-for-a-proper-review-of-hmrc","status":"publish","type":"post","link":"https:\/\/www.taxresearch.org.uk\/Blog\/2015\/05\/21\/it-is-time-for-a-proper-review-of-hmrc\/","title":{"rendered":"It is time for a proper review of HMRC"},"content":{"rendered":"<p>Jolyon Maugham <a href=\"http:\/\/waitingfortax.com\/2015\/05\/20\/hmrc-taking-stock\/\" target=\"_blank\">has posted the following on his blog<\/a> (which I always recommend) this morning, and I cross post it with his permission:<\/p>\n<blockquote><p>Back in February Labour <a href=\"http:\/\/www.taxresearch.org.uk\/Blog\/2015\/02\/14\/ed-milibands-speech-on-tax-avoidance-and-the-reform-of-hmrc\/\">announced <\/a>that it would, if it took power, begin an \u201cimmediate and independent review into the culture and practices of HMRC with regard to tax avoidance.\u201d<\/p>\n<p>This politicisation of the question whether HMRC retained public confidence diffused the logic of the demand. But the\u00a0force of the argument sufficed to\u00a0overcome this handicap.\u00a0A broad church of\u00a0respected industry figures coalesced around a single answer. Paul Aplin, Chair of the ICAEW Tax Faculty Technical Committee, Professor Judith Freedman at Oxford University, Ray McCann and\u00a0Richard Murphy all joined in the call for a review.<\/p>\n<p>The politics have come and gone. But the issue has not got away. Paul Aplin has\u00a0<a href=\"http:\/\/economia.icaew.com\/opinion\/may-2015\/hmrc-still-needs-a-review\">repeated <\/a>the call.\u00a0<a href=\"http:\/\/www.taxation.co.uk\/taxation\/Articles\/2015\/04\/07\/332876\/good-review\">Twice<\/a>\u00a0[\u00a3]. As has <a href=\"https:\/\/twitter.com\/JolyonMaugham\/status\/599140785938952192\">Bill <\/a>Dodwell, Head of Tax Policy at Deloitte. And so, too, <a href=\"https:\/\/twitter.com\/JONATHAN_RILE\/status\/601012996165468160\">apparently<\/a>,\u00a0Grant Thornton.\u00a0Let me, here,\u00a0add my voice to theirs.<\/p>\n<p>There is much that we agree on. We each of us identify the need for a review\u00a0as stemming from a breakdown in public confidence in HMRC: of\u00a0this, and\u00a0the threat\u00a0it poses to\u00a0social cohesion, there can be no serious doubt.<\/p>\n<p>We all, no doubt,\u00a0understand the difficulties\u00a0arising from a constrained funding environment.\u00a0But even proceeding from this premise,\u00a0there remains much that might be done to improve the relationship between HMRC and the public it serves.<\/p>\n<p>Political accountability must be enhanced: whilst I have heard the arguments, I still do not understand the case for HMRC remaining a department without a minister.<\/p>\n<p>Transparency goes arm in arm with accountability: the culture of HMRC must change so that it proceeds instead from the assumption that the public has a legitimate interest in understanding the basis on which decisions are made.\u00a0Whilst\u00a0plainly there\u00a0will be\u00a0hard cases,\u00a0even under the law as it presently stands there is high level authority for the proposition that HMRC could move some way from the status quo.<\/p>\n<p>Whilst there is disagreement amongst professionals as to whether the recent extensions to HMRC\u2019s powers are justified, there is\u00a0an emergent consensus that those powers are\u00a0subject to inadequate\u00a0internal\u00a0and external\u00a0control and supervision. These failings are not only\u00a0to be found\u00a0at HMRC \u2014 but\u00a0it is there that rebalancing\u00a0the\u00a0culture must begin.<\/p>\n<p>As I and many others have observed, the proper functioning of our tax\u00a0system is materially\u00a0contingent upon the public\u2019s voluntary obeisance to it. That obeisance is under strain. Lose it and it won\u2019t be recovered in a dozen Finance Bills.<\/p><\/blockquote>\n<p>I agree, although I think Jolyon's suggested remit is too narrow and shows his legal background.\u00a0I would include the need for a thorough review of the governance of HMRC in the brief. As I have said before, and will say again, it is absurd that HMRC's board is made up from the large business community and its advisers, who between them represent about 700 tax payers when there are 31 million income tax payers alone in the UK.<\/p>\n<p>It is also absurd that parliament has almost no resources available to it to scrutinise HMRC. <a title=\"On Margaret Hodge and the PAC\" href=\"http:\/\/www.taxresearch.org.uk\/Blog\/2015\/05\/21\/on-margaret-hodge-and-the-pac\/\" target=\"_blank\">Margaret Hodge may have done well<\/a>, but it was despite the National Audit Office and not because of them. Indeed, the NAO fought long and hard to deny information on HMRC to the PAC.\u00a0That is wholly unacceptable and must change.
