{"id":19590,"date":"2013-03-13T09:43:19","date_gmt":"2013-03-13T09:43:19","guid":{"rendered":"http:\/\/www.taxresearch.org.uk\/Blog\/?p=19590"},"modified":"2013-03-13T11:24:30","modified_gmt":"2013-03-13T11:24:30","slug":"19590","status":"publish","type":"post","link":"https:\/\/www.taxresearch.org.uk\/Blog\/2013\/03\/13\/19590\/","title":{"rendered":"The Lords say the General Anti-Abuse Rule&#8217;s a step in the right direction &#8211; clearly expecting more in time"},"content":{"rendered":"<p>It took a long time, a lot of lobbying and some luck to get a\u00a0general anti-avoidance rule (or\u00a0General Anti-Abuse Rule as it now is) onto any\u00a0government's\u00a0agenda in the UK.\u00a0Judith\u00a0Freedman at the Oxford Centre for Business Taxation worked on that call. <a href=\"http:\/\/www.taxjustice.net\/cms\/upload\/pdf\/AABA-TR-Code_long.pdf\" target=\"_blank\">So did I.<\/a> And very few others did, but now we are to have one and the House of Lords has this morning issued a report on the subject. I was one of those who gave evidence at their hearings.<\/p>\n<p>The <a href=\"http:\/\/www.publications.parliament.uk\/pa\/ld201213\/ldselect\/ldeconaf\/139\/139.pdf\" target=\"_blank\">report's conclusion <\/a>is:<\/p>\n<blockquote><p>Given resource constraints and the need to provide certainty for business and to promote UK competitiveness, we regard the narrowly focused GAAR as a reasonable starting point. However, we think it important that the scope of the GAAR should be reviewed in the light of practical experience of its operation as part of the wider review that we recommend elsewhere in this report.
