{"id":18411,"date":"2012-11-30T09:33:01","date_gmt":"2012-11-30T09:33:01","guid":{"rendered":"http:\/\/www.taxresearch.org.uk\/Blog\/?p=18411"},"modified":"2012-11-30T09:33:01","modified_gmt":"2012-11-30T09:33:01","slug":"the-ft-says-its-time-to-scrap-the-uk-swiss-tax-deal-because-it-grants-cheats-a-privilege","status":"publish","type":"post","link":"https:\/\/www.taxresearch.org.uk\/Blog\/2012\/11\/30\/the-ft-says-its-time-to-scrap-the-uk-swiss-tax-deal-because-it-grants-cheats-a-privilege\/","title":{"rendered":"The FT says it&#8217;s time to scrap the UK &#8211; Swiss tax deal because &#8220;it grants cheats a privilege&#8221;"},"content":{"rendered":"<p>The FT has, in a very\u00a0welcome\u00a0editorial, come out strongly against the depl;y\u00a0offensive\u00a0UK - Switzerland tax deal that was made UK law this year and which comes into effect soon.\u00a0Commenting favourably on the German parliaments recent\u00a0rejection\u00a0of a<a href=\"http:\/\/www.ft.com\/cms\/s\/0\/a0845694-3a22-11e2-a00d-00144feabdc0.html#ixzz2DhDxVsxH\" target=\"_blank\"> similar deal it says<\/a>:<\/p>\n<blockquote><p>The\u00a0<a title=\"Germany rejects landmark Swiss tax deal\" href=\"http:\/\/www.ft.com\/cms\/s\/0\/6f858fd8-33e5-11e2-9ce7-00144feabdc0.html\">rejection of a tax agreement with Switzerland<\/a>\u00a0by the upper house of Germany\u2019s parliament is a welcome opportunity to revisit a deal that was too lenient on tax evaders and those who aid and abet them. The UK and Austria, which have struck similar deals with Bern, should also see the virtues of a tougher approach.<\/p><\/blockquote>\n<p>Quite so. And it adds:<\/p>\n<blockquote><p>The deals are all cast in the same mould: the countries\u2019 own tax authorities abdicate their task to Swiss banks, which will charge anonymous account holders a one-off fee on assets deposited in the past and a regular withholding tax on future income. This money \u2014 but not information about the owners\u2019 identities \u2014 will flow back to the national treasuries to which the taxes were originally owed.<\/p>\n<p>This is better than nothing, even if it may not make back what was originally owed. The sanctioning of anonymity, however, breaches a basic principle: not to grant cheaters a privilege \u2014 the ability not to declare their taxable income or assets to the proper authorities \u2014 denied to those who play by the rules. This is an injustice in its own right. It also raises the question of how the new agreement can be trusted to work in practice.<\/p><\/blockquote>\n<p>Precisely.<\/p>\n<p>And as it then notes, the US approach is so much better:<\/p>\n<blockquote><p>By contrast, the US authorities insist on being told which American taxpayers squirrel money away in the Alpine refuge, and are prepared to make life insufferable for Swiss banks that operate in the US unless they comply with its wishes.<\/p><\/blockquote>\n<p>Which is\u00a0exactly\u00a0what we\u00a0should\u00a0do: no\u00a0information\u00a0and no banking in London by Swiss banks is an easy equation to\u00a0understand.\u00a0 As they say:<\/p>\n<blockquote><p>Playing hardball works: Swiss banks are edging towards closing accounts of clients who hide from the taxman. The UK, with its big financial centre, has even more leverage. It is reported to be piggybacking on US legislation to break the secrecy of its own Channel island dependencies. It should follow the US lead vis a vis Switzerland as well.<\/p><\/blockquote>\n<div>\u00a0Good to see that the <a title=\"The days of the UK\u2019s tax havens are numbered \u2014 the Treasury is taking steps to shatter their secrecy forever\" href=\"http:\/\/www.taxresearch.org.uk\/Blog\/2012\/11\/23\/the-days-of-the-uks-tax-havens-are-numbered-the-treasury-is-taking-steps-to-shatter-their-secrecy-forever\/\" target=\"_blank\">news leaked a week ago that the UK is looking to impose<\/a> US style\u00a0regulation\u00a0on the\u00a0Crown Dependencies is already changing debate.
